Privacy Policy

Last updated: October 3, 2026

This Privacy Policy explains how I AmErica’s Flags (“I AmErica’s Flags,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit iamericasflags.com (the “Site”), place an order, contact us, or sign up for our email list.

We are a retail business located at 367 N. Trade Days Blvd., Canton, Texas 75103. Our store is operated for customers in the United States. See the Terms and Conditions for where we sell and ship.

This policy works together with our Cookie Policy, which describes the cookies and tracking technologies used on the Site and how you control them.

1. Information We Collect

Information you give us

  • Order and billing information. Your name, billing address, shipping address, email address, and phone number when you place an order.
  • Payment information. Card details are entered into fields hosted by our payment processor and are transmitted directly to it. We do not receive or store your full card number, expiration date, or security code. We receive a transaction result, the last four digits of the card, the card brand, and the address verification and card verification response codes returned by the processor.
  • Account information. If you create an account, your username, password (stored in hashed form), and saved addresses and order history.
  • Communications. The contents of messages you send us through our contact form, by email, or by phone, including any information you choose to include.
  • Email list information. Your email address, and any name you provide, when you subscribe to our newsletter.
  • Content you submit. Photographs, images, comments, and other material you send us or post, as described in the Customer Content section of our Terms and Conditions.

Information collected automatically

  • Device and usage information. Your IP address, browser type and version, operating system, device type, screen size, referring page, the pages you view, the products you view, search terms used on the Site, and the dates and times of your visits.
  • Server and security logs. Our hosting provider and security software record access attempts, requested URLs, and IP addresses to operate the Site and to detect and prevent abuse, fraud, and unauthorized access.
  • Cookies and similar technologies. Described in full in our Cookie Policy.

Information we receive from others

  • Payment and fraud signals. Our payment processor returns authorization results, address verification results, and fraud screening outcomes.
  • Shipping and delivery data. Our shipping and fulfillment providers return tracking numbers, delivery status, and address validation results.
  • Advertising and analytics measurement. Advertising and analytics providers return aggregated and pseudonymous measurement data about how visitors reach and use the Site.

2. How We Use Your Information

We use personal information to:

  • Process, fulfill, ship, and deliver your orders, and provide order confirmations and shipment tracking.
  • Handle returns, exchanges, refunds, cancellations, and warranty or damage claims.
  • Respond to your questions and provide customer service.
  • Create and maintain your account, if you choose to create one.
  • Send you marketing emails about products, promotions, and offers, where you have signed up to receive them.
  • Detect, investigate, and prevent fraud, unauthorized transactions, and abuse of the Site.
  • Verify shipping addresses and reduce failed and misdirected deliveries.
  • Measure and improve the performance of the Site, our product selection, and our advertising.
  • Display advertising to you on other websites and platforms, as described below.
  • Comply with our legal obligations, including tax, accounting, and recordkeeping requirements, and enforce our terms and agreements.

3. How We Share Your Information

We do not sell your personal information for money. We do share limited information with the service providers that make our store work, and we share certain online identifiers with advertising partners for targeted advertising, which some state privacy laws treat as a “sale” or “sharing.” Section 6 explains how to opt out.

Other circumstances

  • Legal requirements. We may disclose information where required by law, subpoena, court order, or other legal process, or where we believe disclosure is reasonably necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
  • Business transfers. If we are involved in a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of that transaction. We will take reasonable steps to require that it remains protected under terms consistent with this policy.

4. Advertising and Analytics

We use Google Analytics to understand how visitors find and use the Site, and Google Ads to advertise our products. These services set cookies and similar identifiers that allow us to measure the results of our advertising and to show our ads to people who have previously visited the Site. This is commonly called remarketing or targeted advertising.

Under Texas and California privacy law, sharing online identifiers with advertising partners in this way may be treated as “targeted advertising,” a “sale,” or “sharing” of personal information, even though no money changes hands. You have the right to opt out. See Section 6.

You can also control Google’s use of your data directly through Google Ads Settings, and you can install the Google Analytics opt-out browser add-on.

5. Email Marketing

We send marketing email only to people who have signed up for it. Every marketing email includes an unsubscribe link, and we act on unsubscribe requests promptly. You can also email us at help@iamericasflags.com to be removed.

Unsubscribing from marketing email does not stop transactional messages about orders you have placed, such as order confirmations, shipping notifications, and responses to your customer service inquiries.

6. Your Privacy Rights and How to Exercise Them

Rights available to Texas residents

Under the Texas Data Privacy and Security Act, Texas residents have the right to:

  • Confirm whether we are processing your personal data and access that data.
  • Correct inaccuracies in your personal data.
  • Delete personal data you provided or that we obtained about you.
  • Obtain a copy of your personal data in a portable and readily usable format, where processing is carried out by automated means.
  • Opt out of the processing of your personal data for targeted advertising, for sale, or for profiling in furtherance of a decision that produces a legal or similarly significant effect.

Rights available to California residents

Under the California Consumer Privacy Act as amended, California residents have the right to know what personal information we collect, use, disclose, and sell or share, the right to access and delete that information, the right to correct inaccurate information, the right to opt out of the sale or sharing of personal information and of targeted advertising, the right to limit the use of sensitive personal information, and the right not to receive discriminatory treatment for exercising any of these rights.

We do not collect sensitive personal information for the purpose of inferring characteristics about you, and we do not use or disclose it beyond what is necessary to provide our products and services.

We have not sold or shared the personal information of consumers we know to be under 16 years of age.

Rights available to residents of other states

Residents of other states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Utah, Oregon, Montana, and others as those laws take effect, have rights substantially similar to those described above. We extend the rights in this section to all of our customers regardless of where they live.

How to make a request

Email help@iamericasflags.com with the subject line “Privacy Request,” or write to us at I AmErica’s Flags, Attn: Privacy Request, 367 N. Trade Days Blvd., Canton, TX 75103. Tell us which right you want to exercise.

We will verify your identity before acting on a request, usually by matching the information you provide against our records, or by asking you to respond from the email address associated with your orders. We may ask for additional information where a request concerns sensitive data or a large volume of records. We do not charge a fee for a reasonable request.

An authorized agent may submit a request on your behalf with written proof of authorization signed by you. We may still contact you directly to confirm.

We will respond within 45 days. Where a request is complex or we receive a high volume of requests, we may extend this once by an additional 45 days and will tell you why before the first period ends.

Appeals

If we decline your request, we will tell you why. You may appeal that decision by replying to our response, or by emailing help@iamericasflags.com with the subject line “Privacy Appeal,” within a reasonable time. We will review the appeal and inform you in writing of our decision and the reasons for it within 60 days. If we deny the appeal, we will give you a method to contact the Texas Attorney General to submit a complaint.

Opting out of targeted advertising, sale, and sharing

You can opt out in any of these ways:

  • Use the “Your Privacy Choices” or “Do Not Sell or Share My Personal Information” link in the footer of this Site.
  • Open the cookie preferences control on this Site and switch off the advertising category.
  • Email help@iamericasflags.com and ask to opt out.

We honor the Global Privacy Control signal. If your browser or a browser extension sends a recognized universal opt-out preference signal, we treat it as a valid request to opt out of targeted advertising and of the sale or sharing of personal information for that browser. Because that signal is tied to a browser, you will need to send it from each browser and device you use.

7. Data Retention

We keep personal information for as long as it is needed for the purpose it was collected, and then for as long as we are required to keep it.

  • Order and transaction records are retained for at least the period required by tax, accounting, and sales tax recordkeeping rules, which is generally a minimum of four years.
  • Account information is retained while your account is open, and for a reasonable period afterward.
  • Email marketing information is retained until you unsubscribe, and then only as needed to honor your unsubscribe request.
  • Customer service correspondence is retained for as long as needed to resolve the matter and for a reasonable period afterward.
  • Server and security logs are retained on a short rolling basis as set by our hosting and security providers.

Where you ask us to delete your information, we will delete it unless we are required to keep it. In that case we will tell you, and we will restrict its use to that purpose only.

8. Security

The Site is served over an encrypted connection, and payment card details are entered into fields hosted by our payment processor so that they are transmitted directly to it rather than passing through or being stored on our systems. We use application level and server level security software, restrict administrative access to people who need it, and keep our software updated.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your account has been compromised, contact us at help@iamericasflags.com immediately.

9. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, contact us at help@iamericasflags.com and we will delete it. You must be at least 18, or have the permission of a parent or guardian, to place an order.

10. Third Party Links

The Site links to websites we do not control, including social media platforms and other businesses. This policy does not apply to those websites, and we are not responsible for their content or their privacy practices. Read the privacy policy of any site you visit.

11. Where We Operate

We are located in the United States and our systems and service providers store and process information in the United States. Our online store is intended for customers in the United States. If you access the Site from outside the United States, you do so on your own initiative and your information will be processed in the United States.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will change the “Last updated” date at the top of this page. Where the change is significant, we will provide a more prominent notice. Continuing to use the Site after a change takes effect means you accept the updated policy.
